Contest Rules
March-April, 2008
THE CONTEST:
1. Entercom San Francisco, LLC (the “Company”), d/b/a 102.1 KDFC (the “Station”) will conduct a contest (the “Contest”) for the chance to win $2,500 check (the “Prize”)
2. NO PURCHASE NECESSARY. All federal, state and local laws and restrictions apply. The Contest is void where prohibited.
3. The Contest will begin on March 1, 2008 and end on April 28, 2008 (the “Contest Period”)
WHO CAN ENTER:
4. Contest is open to anyone who legally resides in one of the nine Bay Area counties (Alameda; San Mateo; Santa Clara; San Francisco; Marin; Napa; Sonoma; Contra Costa; Solano). All contestants who are under 18 years of age will be required to have their legal guardians co-execute all documents required in connection with this Contest and failure to do so in a timely manner will result in automatic disqualification and any Prize will be forfeited. For all purposes under these rules, the parent or legal guardian will be recognized as the actual winner of the Prize and may be taxed on the Prize. The Station will require proof of residency, age, identification and social security number prior to delivering any Prize.
5. Employees of the Station, Contest sponsors and any other San Francisco/San Jose area radio stations, and their respective parent entities, subsidiaries, affiliated companies and advertising and promotion agencies at any time during the Contest Period and the immediate family and other household members (i.e., spouses, parents, grandparents, children, grandchildren, roommates, housemates, significant others, partners and siblings) of each of the above are NOT eligible to enter and/or to win the Contest
6. Professional musicians, any person who is party to, or has ever been party to a professional recording contract, or who makes or has ever made over half of his or her annual income by performing music, or any person who has ever appeared on the official playlist of the Station are all ineligible to enter and/or win.
7. Entrants may be accompanied by one musician, but must submit entry videos (see below) as individuals.
HOW TO ENTER:
8. Eligible persons wishing to enter the Contest (each, an “Entrant”) must submit one (1) recording of themselves performing OR singing a classical work up to 4 minutes in length, via email by uploading a video as instructed at kdfc.com
9. Audition performance must be acoustic, continuous and not edited or enhanced in any way. Music must be classical; Selections written in the popular styles by composers such as Bernstein and Gershwin are acceptable. Music from other genres such as pop or jazz are not eligible.
10. The only video formats accepted are: WMV, AVI, MOV, MP4, MPG, FLV, DV, QT, 3GP. The maximum file size is 300MB.
11. All Entries must be RECEIVED no later than midnight (PST) on Friday, March 28, 2008. Only entries submitted via www.kdfc.com and including all mandatory information on entry documents are eligible.
12. All Entries become property of Station and will not be acknowledged or returned. By submitting an Entry,. Entries must be live performances by entrants of music OR vocals.
13. By entering this Contest, Entrants understand and agree that, if they are chosen as a Semi-Finalist, they must be willing and available to perform a live, judged audition on April 12 or 13 in a Bay Area location.
14. By entering this Contest, Entrants understand and agree that, if they are chosen as a Finalist, they must be willing and available to perform a live, judged performance on April 28 in San Francisco.
15. By entering this Contest, Entrants understand and agree to any subsequent recordings, video or audio, of any Contest performance, and hereby consent to the Station’s use of the Entry on its website and to its being broadcast on-air with no compensation to Entrant
16. By entering this Contest, Entrants represent warrant and covenant that they have obtained permission from accompanist (or from a parent or legal guardian if accompanist is under 18 years of age), consenting to submission of the Entry, participation in the Contest and agreement to the terms of these official Contest rules.
17. By entering this Contest, Entrants understand and agree that Station may elect to use any submitted Entry for entertainment purposes on-air. Entrants waive any right to make any claim against Station, or any Contest sponsors with respect to any disparaging comment made on-air about such Entrant’s Entry.
18. By entering this Contest, Entrants represent, warrant and covenant that (i) the content of Entry will not violate or infringe any rights of third parties; and (ii) Entrants have the right and authority to grant the Station rights to the content provided in the Entry.
19. By entering this Contest, Entrants agree to indemnify, defend and hold Station harmless from and against any claims, expenses proceedings, suits, actions or costs (including costs from reasonable attorneys’ fees) of any kind or nature incurred by Station on account of a breach by Entrant of any of their representations, warranties, covenants or agreements as a result of Entrant’s participation in the Contest.
WINNING:
20. Timely entries will be divided into two group: 1) entrants aged 10 to 20 years old, and 2) entrants 21 years of ages and older.
21. On or about March 31, 2008, Station will select up to 10 Entries (each, a ”Semi-Finalist”) from all timely among Entries received, in each ages group. Entries will be judged by KDFC staff and guest judges based on 1) singing ability 2) overall style (i.e. could this person be the next CLASSICAL STAR?) and such other lawful criteria as determined in Station’s sole discretion. All judgments will be at the sole discretion of Station personnel and their decisions shall be final and non-appealable.
22. Any public votes for Semi-Finalists or Finalists, made through www.kdfc.com, are informational only and non-binding. All judgments will be at the sole discretion of Station personnel and their decisions shall be final and non-appealable.
23. On or about April 21, KDFC will announce 3 Finalists in each of the two categories. All judgments will be at the sole discretion of Station personnel and their decisions shall be final and non-appealable.
24. On April 28, a public event will be held in San Francisco. Finalists will perform live for the audience and judges and a winner in each category will be announced. All judgments will be at the sole discretion of Station personnel and their decisions shall be final and non-appealable.
PRIZE:
25. The Winner in each category will receive $2,500.00 in the form of a company check.
26. There will be one (1) Prize awarded to one (1) Winner in each of the two categories. References in these rules to prizes or winners (plural) shall be deemed to mean prize or winner (singular) in each of the two categories.
27. Winner is responsible for all federal, state, and local taxes and may receive a 1099-misc. form for tax purposes.
28. Prize will be released to Winner only. Winner is required to present a valid state photo ID and social security number in order to claim Prize and sign any other required documentation. Station reserves the right to examine identification and may reasonably choose to accept or deny awarding the Prize based on the information presented. All participants in winning Entry are required to sign a Release relieving the Station, its parents, subsidiaries, officers, directors, members, managers, employees, agents and Contest sponsors from any and all liability with respect to the contestant’s participation in the Contest and the receipt and/or use of the Prize. Any person who refuses to sign the Release and/or provide a social security number will forfeit the Prize.
29. If a Prize is forfeited under these rules, then it will remain the property of the Station, disposed of within Station’s sole discretion.
OTHER RULES:
30. For any public voting, votes will only be accepted from Club KDFC members. Membership is free. Club KDFC (the “Club”) is an internet club that will entitle members to, among other things, receive information from Station and its clients, enter contests, participate in surveys and enjoy many other opportunities. There is no cost to become a member of the Club. To join the Club go to www.kdfc.com and click on the link for the Club and provide all required information (incomplete registrations may be invalidated in Station’s sole discretion). In the event of a dispute regarding the identity of a member, the holder of the e-mail account will be deemed the person who submitted the membership. The holder of the e-mail account is the natural person who is assigned the e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the second level domain associated with the e-mail address in question. Limit one membership per person and one membership per e-mail address. Members are required to provide truthful information when completing Club membership registration form. If Station determines that any registration form contains false or fraudulent information or is submitted by a person other than the one named in the form or by an ineligible entrant, such form will be disqualified and that member will be prohibited from participating in this contest. 31. Station retains sole and exclusive possession and retains all rights to use any Entry, or any part thereof, including but not limited to the musical performance submitted with an Entry, indefinitely in any promotions including, but not limited, to on-air usage without any compensation to Entrants or any third parties. The aforementioned stipulations apply to all winning and non-winning Entries. Station is not responsible for any costs associated with submitting any Entry or any costs arising out of participating in the Contest or failure to adhere to official Contest rules.
32. By participating in the Station Contest, each Entrant and each associated participant hereby consents to the Station and Contest sponsors’, if any, usage of any one or more of the following for advertising and promotional purposes in all media without payment of additional consideration: Entrant’s name; recorded Entry submission; voice; likeness; image; biographical information; and/or participation in the Contest. Each Entrant agrees to waive any claim of royalty or right of further remuneration for any such promotional use.
33. Station is not responsible for technical problems that may impact the ability of an Entry to be submitted, or played once received by Station.
34. Station is not responsible for any technical difficulties that may prevent an individual from entering the contest. Station assumes no responsibility for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed, or misdirected transmissions, or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of information or the failure to capture, or loss of, any such information. Station assumes no responsibility for any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in this Contest; any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the website. If, for any reason, Contest, in the sole opinion of Station, is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in sole opinion of the Station, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Station reserves the right, at its sole discretion, to cancel, terminate, modify or suspend Contest.
35. By participating in the Contest, each Entrant and each associated participant hereby agrees that Station has no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession and/or use of a Prize or an Entrant’s and each associated participant’s participation in the Contest.
36. Entries received by Station that are mutilated, tampered with, illegible, from ineligible Entrants, or damaged in any way as determined by Station in its sole discretion will be void. Station is not responsible for lost, late, or misdirected mail. Entries that are determined by Station to be fraudulent will be void and the person making such an entry barred from further participation in the Contest.
37. Station reserves the right to terminate or declare this Contest null and void and rescind any Contest awards if in its sole judgment, the rules or the integrity of this Contest have been violated or compromised in any way, intentionally or unintentionally by any person whether or not a participant in this Contest. Station personnel shall be the sole judges of the Contest and in interpreting these rules, their decisions shall be final.
38. Station reserves the right to alter or amend Contest rules or to stop the Contest at any time. Material changes to the Contest rules will be broadcast on-air, when practical. All entries become property of Station and will not be acknowledged or returned.
39. Entry into this Contest constitutes agreement by contestants to abide by these and any other rules set forth by the Station. Qualifying spots are not assignable or transferable. Prize is not transferable or assignable.
40. A complete copy of the rules are available during the Contest Period at the Station studios (201 Third St. #1200, San Francisco CA 94103) between 9am and 5pm and at www.kdfc.com.
41. For a list of winners mail a self-addressed stamped envelope to “Classical Star Search”, 201 Third St. #1200, San Francisco CA 94103, after April 28, 2008 but prior to July 28, 2008. |
